My dear Father,
Upon receipt of your letter I wrote immediately to Mr. Wyatt, and recieved from him the reply of which you have a copy annexed. I have an appointment with some engine customers on Monday which will prevent me from accompanying Mr. Wyatt to Wooten on that day, but I will endeavour to join him there on the following. Mr. Wyatt, you will observe, proposes to employ two or three days in the survey, which may possibly be necessary to form a correct judgement of the land, but as I cannot assist him in this particular, a much shorter time will suffice for my observations.
From Snape's plan of the farms, annexed to the printed particulars, I see they lie very detached. Bearley Farm appears to be nearly three miles from the others, and some of the farms, particularly those in the occupation of Ward and Gibb, are much interspersed with the lands of the neighbouring proprietors.
I presume you have noticed the last clause in the conditions of sale, whereby the estate is sold with the option to the lessee of repurchasing it any time before the completion of the sale-meaning, I suppose, before the whole of the purchase money is paid up. Sir Edward Smith, Bart., I understand to be the beneficial leaseholder, or the person entitled to this option, and, the estates surrounding his residence, I should think it not improbable that he would endeavour to avail himself of the priviledge.
Mr. Watt senior desires me to remark, for your consideration, that he believes legal doubts have been started as to the powers of the College to rescind a lease granted according to the custom of church leases, which he understands to be receivable every seven years, upon payment of a fine. He says many estates have been held under this tenure by long succession of years, and that the possession of them has latterly been considered as a perpetuity, subject to the payment of a chief rent. . .
